A New Paradigm for Dismantling Medical Debt: Lessons from New Jersey

As healthcare costs continue to skyrocket nationwide and with devastating federal cuts to programs like Medicaid on the horizon, states are grappling with medical debt as a long-term crisis — with one in five Americans already reporting worry over unexpected medical bills. Into this landscape, New Jersey Appleseed is building an integrated model that combines legal empowerment, policy reform, and debt abolition.

Empowerment Through Education and Transparency

At the heart of this initiative is New Jersey Appleseed’s Medical Debt Manual, now hosted on endmeddebtnj.org, which guides individuals — regardless of income, legal status, or technical know-how — through challenging surprise bills, appealing denials, and negotiating debt settlements. This site features plain-language manuals in English and Spanish, fillable forms, and FAQs, with short video tutorials to be added later. This approach demystifies the process and enables self-advocacy — a powerful complement to formal legal support systems.

New Jersey Appleseed also worked with the court system to implement two key rule changes: One court rule change now requires plaintiffs to declare if their lawsuit involves medical debt, and the second rule change requires courts to tell people who are sued for medical debt that there is a required settlement conference before trial if they answer the complaint. Together, these rule changes give the public critical information about medical debt in the community, and they provide debt defendants the information they need to navigate the legal system.

Recognizing the strain medical debt cases place on court systems, NJ Appleseed is spearheading a new initiative aimed explicitly at diverting these cases out of the courts. By providing clear pathways to settlement and proactive dispute resolution, this next phase of work aims to reduce court burdens and promote early, equitable resolutions for individuals struggling with medical debt.

A Scalable Blueprint

What makes this approach noteworthy beyond New Jersey?

  • First, educational tools — like the NJ Medical Debt Manual — are easily adapted by legal clinics, community nonprofits, and bar associations in other states.
  • Second, legal reforms — like banning credit-reporting — offer accessible legislative models for other jurisdictions seeking to protect their residents.

Critically, New Jersey’s Louisa Carman Medical Debt Relief Act mandates that providers enter into reasonable payment plans based on patient income, empowering individuals with a clear path to manageable debt resolution. NJ Appleseed’s practical, user-friendly negotiation form in their manual’s appendix helps individuals navigate the process.

COVID-era federal relief led to nearly $7 billion in medical debt forgiveness across states and municipalities, but gaps and inequities remain and are likely to grow with new federal healthcare cuts. As national policy falters, New Jersey Appleseed’s work provides a blueprint for states and communities across the country to address the critical needs of families facing growing medical debt from Medicaid cuts.
